Dear Editor: For the crime of kidnapping 5 young women, you would expect the perpetrator to be jailed or at least have a conviction registered and in the case of the perpetrator being an Australian that would be the case. But the Australian judiciary has 2 standards, one for Australians and one for foreigners from non-western countries who want to immigrate here. Queensland Judge Katherine McGinnes told Indian student Karan Luthra, 25 he had jeopardised his planned new life in Australia in relation to kidnapping 5 young women. However she exercised her discretion not to impose a conviction and sentenced him to 80 hours community service and 12 month's probation so that he would not be deported and could still have the opportunity of living in Australia. Would an Australian be treated this lenient in India, no way it would be jail. This unfortunately is not an isolated case of the Judiciary giving leniency to potential immigrant criminals and imposing a fictional right to immigrate before the rights of the Australian victims to see Justice done. If he was not a potential immigrant he would have been jailed. Our immigration laws are a joke and this loophole of being found guilty but no conviction recorded must be closed so that foreign criminals are deported. Regards Greg Sermon Perth Wa
